Article II Executive Branch
“Whatever of dignity or authority he (president) possesses, is a delegated part of their Majesty (the people) and their political omnipotence, transiently vest in him by the people themselves for their own happiness.” DC.An American Citizen.24
Article II Section 1 “No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President.”
God of Israel “You shall set as king over you one from among your brothers. You may not put a foreigner over you, who is not your brother.” Dt.17.15
Article II Section 2 “and he shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.
Seneca says that a pardon should no be general allowing the distinction between good men and bad men to be abolished, if so, chaos will follow with a rise of vice. Pardons must be applied according the curable and incurable. The clemency should not be promiscuous, to pardon everyone is as cruel as to pardon none. 140
Article II Section 3 The President “…shall take Care that the Laws be faithfully executed…”
Fl Constitution Article II, Section 3 “The powers of the state government shall be divided into legislative, executive and judicial branches. No person belonging to one branch shall exercise any powers appertaining to either of the other branches unless expressly provided herein.”
Note: Montesquieu rightly says liberty requires the judicial, executive and legislature to be separate branches.

Rutherford “The advancing of any man to the throne and royal dignity putteth not the man above the number of rational men.” 138
An American Citizen ”In America, as the president is to be one of the people at the end of his short term, so will he and his fellow citizens remember, that he was originally one of the people; and that he is created by their breath.”. dc.22.3
Deuteronomy 17:20 “that his heart (King) not be lifted up above his brothers, and that he not turn aside from the commandment, to the right hand, or to the left…”
Rutherford “Royalty never advances the king above the place of a member.” 87
Rutherford “Now the king, at his coronation-covenant with the people, giveth a most intense consent, an oath, to be a keeper and preserver of all good laws: and so hardly he can be freed from the strictest obligation that law can impose.” 129
Note: US Constitution requires the President of the United States to to faithfully execute the laws of the land. This requirement itself puts the President under law and not over the law. Therefore fulfilling the Biblical requirement of equal under law.
Article II Section 1 :The President shall, at stated times, receive for his services, a compensation, which shall neither be increased nor diminished during the period for which he shall have been elected, and he shall not receive within that period any other emolument from the United States, or any of them.
God of Israel “Only he shall not multiply horses to himself, nor cause the people to return to Egypt, to the end that he may multiply horses; because Yahweh has said to you, “You shall not go back that way again.” He shall not multiply wives to himself, that his heart not turn away. He shall not greatly multiply to himself silver and gold.” Dt 17:16-17
Note: The US Constitution limits the pay of not just the executive, but also judicial and congressmen. This fulfills the God’s mandate that the resources of government and its powers are for the welfare of the people and not for the advantages and benefits of public servants; the states concur in this assessment. It should be of note that today we find some in public office who multiply wives, that is re-marry while in office, who use public power to pervert public policy in order multiply personal riches, and who increase horses or horsepower with government paid for jets.
For the Scripture says, “You shall not muzzle the ox when it treads out the grain. And, “The laborer is worthy of his wages.” 1 Tim 5:18
Representative Fisher Ames “Every man is eligible, by the constitution, to be chosen to this office; but if a competent support is not allowed, the choice will be confined to opulent characters. This is an aristocratic idea, and contravenes the spirit of the constitution.” 181.aconst
George Washington as to sufficient salaries as necessary said “it would be repugnant to the vital principles of our government, virtually to exclude from public trusts, talents and virtue, unless accompanied by wealth.”

John of Salisbury “It is said that when someone is empowered who declares himself a brother of the whole people in matters of religious worship and in the feeling of charity..” 36

John of Salisbury..”…he should not multiply horses, since the greatness of their number is a burden to subjects.” “It is said that when someone is empowered who declares himself a brother of the whole people in matters of religious worship and in the feeling of charity..” “For ‘too much’ and ‘too little’, if one follows the Prince of the Peripatetics, signify the excess or diminution of legitimate quantities within particular genera of things.” 36
The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States;
“…he may require the opinion, in writing, of the principal officer in each of the executive departments, upon any subject relating to the duties of their respective offices…”
Note: Soliciting information was limited to the duties of the respective offices counter-distinction to the English king who could solicit the privy counsel to help with his personal lands; this stems from the fact that the king’s household was his court and counselors, and the kings revenues were public revenues for running the country which included his profits from his lands and privileges such relief, wards, marriages, and scutage.

High Crimes and Misdemeanors
Section 4 The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.
Rutherford. “If a king turn a parricide, a lion, and a waster and destroyer of the people, as a man he is subject to the co-active power of the laws of the land. If any law should hinder that a tyrant should not be punished by law, it must be because he hath not a superior but God….” 128
Note: The US Constitution is advancement than the constitutional monarchy of the ancient Israel where King David committed a high crime of adultery and murder and was not punished for there was no impeachment clause in its constitution since the people had yet assumed sovereignty over their magistrates.
Seneca of Rome writes that “pardon should not be general, for if the distinction between bad men and good is abolished, chaos will follow and an eruption of vice. We must therefore apply a moderation capable of distinguishing the curable from the hopeless. The clemency we practice should neither be promiscuous…”
Unless sorrowful repentance is overtly displayed by the convicted, the remitting of punishment of harden criminals is an endangerment to the public. If and when the president offers clemency to an enemy of society, and the freed criminal commits an additional act of aggression up the life, liberty and property of any citizen, the releaser – the President – has become an accessory to the crime. If a felony is committed upon society then the releaser ought to be charged as an accessory to the felony, such is the nature of justice, and any other rule is folly.
